These Terms of Service ("Terms") govern your use of stoptexasforeclosures.com (the "Site") and the free advisory services offered by X Home ("we" or "us"). By using the Site or our services you agree to these Terms. If you do not agree, please do not use them.
1. Who we are - and what we are not
X Home is a Texas-based real estate advisory and acquisition company headquartered in Fort Worth, Texas. We help Texas homeowners facing foreclosure understand the options available to them. Any real estate offers and contracts we make use Texas Real Estate Commission (TREC) forms.
We are not, and these Terms do not establish us as, any of the following:
- - A law firm or provider of legal advice
- - A government agency or instrumentality
- - A lender, mortgage broker, or mortgage servicer
- - A credit repair organization or credit counseling service
- - A HUD-approved housing counseling agency
- - A licensed financial planner, accountant, or tax advisor
We are not affiliated with HUD, VA, FHA, Fannie Mae, Freddie Mac, or any other federal, state, or local government program. References to those entities or programs on the Site are descriptive only and do not imply affiliation or endorsement. When you need a licensed professional in one of these fields, we will tell you so and, where appropriate, refer you to one we trust.
2. Our services are free to homeowners
X Home does not charge homeowners any fee for the advisory conversations, options reviews, or referrals offered through the Site. If we acquire a property from you under a separate signed agreement, the terms and any costs of that acquisition are governed by that agreement and applicable TREC forms - not by these Terms.
We never ask homeowners to pay us up front. If anyone claiming to represent X Home asks you to pay a fee in advance to stop a foreclosure, please contact us at 817-204-5273 immediately - that person is not authorized to act on our behalf.
3. No guarantees, no specific outcomes
Foreclosure outcomes depend on factors outside our control, including your lender's policies, your loan documents, your individual financial situation, court schedules, applicable law, and timing. We do not guarantee that any foreclosure can be stopped, delayed, or modified, and we do not promise any specific result, savings, or timeline. Any examples, case histories, or testimonials on the Site describe past situations and do not predict your outcome.
4. The Site is informational, not advice
Content on the Site is provided for general information about Texas foreclosure options. It is not legal advice, financial advice, tax advice, or real estate advice tailored to your situation. You should consult a licensed attorney, accountant, or other qualified professional about your specific circumstances before making decisions that affect your home or your finances.
5. Communications and consent to contact
By submitting any form on the Site or otherwise contacting us, you authorize X Home to contact you by phone, text message, and email at the contact information you provide, including by automated means, regarding your inquiry and related foreclosure options. You may opt out of further communications at any time by replying "STOP" to a text, telling us by phone, or emailing anthony@xhomeadvisors.com. Standard message and data rates may apply to text messages.
Communications between you and X Home are not subject to attorney-client privilege because we are not your attorney.
6. Information you provide must be accurate
You agree that any information you share with X Home about yourself, your property, or your loan is true and accurate to the best of your knowledge. The guidance we provide depends on the accuracy of that information. You also agree not to use the Site or our services in a way that violates any law or infringes anyone else's rights.
7. Intellectual property
The Site and its content - including text, graphics, logos, photographs, and the X Home name and marks - are owned by X Home or our licensors and are protected by U.S. and international intellectual property laws. You may view and share the Site for personal, non-commercial use. You may not copy, reproduce, modify, distribute, or use the Site or its content for commercial purposes without our prior written consent.
8. Third-party content and referrals
The Site may contain links to, or describe services provided by, third parties such as attorneys, lenders, housing counselors, and real estate agents. We do not control those third parties and are not responsible for their content, services, or actions. Any engagement you have with a third party is solely between you and that party.
9. Disclaimer of warranties
THE SITE AND ALL ADVISORY SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. X HOME DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, X HOME, ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR ADVISORY SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SITE OR THE ADVISORY SERVICES IS LIMITED TO ONE HUNDRED DOLLARS ($100). Because our advisory services are free, you have not paid us anything that we could refund as damages.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.
11. Indemnification
You agree to indemnify and hold X Home and its members, managers, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
12. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you and X Home consent to the personal jurisdiction of those courts.
13. Compliance with foreclosure-specific rules
We strive to comply with applicable Texas and federal rules governing communications with homeowners in foreclosure, including the Texas Property Code (including Chapter 51 governing non-judicial foreclosure), the Federal Trade Commission's rules on mortgage assistance relief services where applicable, the Telephone Consumer Protection Act, the CAN-SPAM Act, and the Fair Credit Reporting Act. We do not use the phrase "foreclosure relief" to describe our services, and we never collect advance fees from homeowners.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be highlighted on the Site for a reasonable period. Your continued use of the Site after changes are posted means you accept the revised Terms.
